MINUTES OF COUNCIL

A regular session of Troy City Council was held Monday, May 21, 2001, at 7:30 p.m. in the basement level meeting room of City Hall (temporary meeting place).

Members Present: Baker, Beamish, Douglas, Howe, Mercer and Saxton.
Upon motion of Mrs. Saxton, second by Mrs. Baker, Mr. Bretland was excused from this meeting by unanimous roll call vote.

PUBLIC HEARINGS:
At 7:31 p.m., Mr. Lohrer declared open a public hearing on Ordinance No. O-10-01. There were no comments in this regard, and at 7:32 p.m., Mr. Lohrer declared this public hearing closed.

At 7:32 p.m., Mr. Lohrer declared open a public hearing on Ordinance No. O-11-01. George Oberer, Jr., developer, stated the rezoning request was due to:
-The R-3 zoning was applicable when the Edgewater was going to be part of a Homearama, but as that event did not take place, the zoning is not now applicable.
- The developer had anticipated purchasing/annexing adjacent land that would have enhanced the R-3 property, but that plan could not be completed.
- Based on a design layout, only 10 additional lots would be added.
- If the zoning remained R-3, the roadway to the R-3 lots goes through R-4 lots, and that does not seem appropriate.
- The market will not support the R-3 lots.
There being no further comments, at 7:40 p.m., Mr. Lohrer declared this public hearing closed.

The Clerk gave a summary of the May 7, 2001, minutes of Council. There were no corrections or additions to these minutes. Upon motion of Mrs. Baker, seconded by Mr. Beamish, these minutes were approved by unanimous roll call vote. 

COMMITTEE REPORTS: 
LAW & ORDINANCE COMMITTEE: Mr. Douglas, Chairman, reported that Committee recommends emergency legislation be prepared authorizing the purchase of two parcels, .697 acres and 5.493 acres, with access to Staunton Road, at a cost of $30,000 as the land can serve for well field protection and as green space.

ORDINANCE NO. O-10-01
ORDINANCE AMENDING THE PLANNED DEVELOPMENT FOR OUTLOT 235 IN THE CITY OF TROY, OHIO REGARDING STOUDER CENTER

Given public hearing and second title reading.

ORDINANCE NO. O-11-01
ORDINANCE CHANGING ZONING FOR PART OF INLOT 7167 IN THE CITY OF TROY, OHIO, FROM R-3, SINGLE FAMILY RESIDENCE DISTRICT TO R-4, SINGLE FAMILY RESIDENCE DISTRICT

Given public hearing and second title reading.

ORDINANCE NO. O-12-01
ORDINANCE AUTHORIZING THE DIRECTOR OF PUBLIC SERVICE AND SAFETY OF THE CITY OF TROY, OHIO, TO ENTER INTO AN AGREEMENT FOR THE PURCHASE OF APPROXIMATELY SIX ACRES OF REAL ESTATE FOR WELL FIELD PROTECTION FOR THE CITY OF TROY AND DECLARING AN EMERGENCY

Mr. Douglas moved for suspension of three readings. Motion seconded by Mrs. Saxton.

COMMENTS OF MAYOR: The Mayor commented that the census data show's Troy's 2000 population at 21,999 and that Troy is now the largest City in the County. 

COUNCIL COMMENTS: 
-Mr. Mercer noted that there have been recent articles about water usage alleged at the Troy Country Club, and commented that as the County contracts with the City for water, the City is paid for all water that goes through the County's meter. 

AUDIENCE COMMENTS: Lloyd Rowe, 385 W. Ross, stated he feels the new outdoor warning system is insufficient as it cannot be heard indoors, whereas he could hear the previous system indoors. It was noted that the system is not intended to provide warning inside a structure - it is an outdoor system to advise those out of doors to take cover. It was noted that additional units can be added (approximately $30,000) each, but the system has been functioning as designed.

PRESENTATIONS: Mark Livengood, Utilities Supervisor, recapped utilities improvements over the past decade and commented about future issues. Mr. Livengood talked about the City's excellent quality of water that is delivered at a low cost. In response to a question from Mr. Mercer, Mr. Livengood stated that growth - residential, commercial and industrial - helps keep rates low as there are more customers to absorb the cost of improvements. Mr. Douglas commented that the utilities areas are highly regulated by other entities and there are mandates over which the City has no control, but must comply with and fund.

Steve Dunne, Director, PTCC, commented that since his last report: a position has been filled, programs have been added in response to viewer requests, some recent TV auctions/promotions have brought in revenue, and they have not heard about their funding request to the Troy Foundation.
