MINUTES OF COUNCIL
A regular session of Troy City Council was held Tuesday, September 3, 2002,
at 7:00 p.m. in Council Chambers.
Members Present: Baker, Beamish, Bretland, Cultice, Mercer, Saxton and Wise.
Presiding Officer: William F. Lohrer, President of Council
Others Present: Peter E. Jenkins, Mayor

An invocation was given by Councilmember Cultice.
MINUTES: The Clerk gave a summary of the August 15, 2002 meeting of Council.
There were no corrections or additions in this regard, and upon motion of
Mrs. Saxton, seconded by Mr. Beamish, these minutes were approved by
unanimous roll call vote.
COMMITTEE REPORTS:
LAW & ORDINANCE. Mrs. Saxton, Chairman, reported as follows: 1) That
Committee recommends legislation be prepared granting an easement for a 3'
encroachment on Crawford Street, adjacent to St. Patrick Church, requested
by St. Patrick Church in order to provide a handicap access ramp to the
church basement. 2) Committee recommends legislation be prepared vacating an
unneeded storm sewer easement shown on the plat to the rear of Kings Tower
Shopping Center. 3) Committee recommends legislation be prepared accepting
the final plat of Section One of the Nottingham Subdivision, including the
dedication of 2.3788 acres of park land, acceptance of a water line utility
easement and acceptance easements for two storm water detention areas.

Mrs. Saxton gave the oral report that notice of new C1 and C2 liquor permit
applications have been received for the Road Pop Stop, Inc. to be located at
1265 S. Dorset Road.
UTILITIES. Mr. Mercer, Chairman, reported that Committee recommends
legislation be prepared authorizing bidding of the cleaning of the East lime
sludge lagoon at a cost not to exceed $125,000.

RESOLUTION NO. R-59-02
RESOLUTION AUTHORIZING THE DIRECTOR OF PUBLIC SERVICE AND SAFETY OF THE CITY
OF TROY, OHIO TO ADVERTISE FOR BIDS AND ENTER INTO A CONTRACT FOR THE
CLEANING OF THE EAST LIME SLUDGE LAGOON

ORDINANCE NO. O-39-02
ORDINANCE CHANGING THE ZONING OF PART OF INLOTS 6046 AND 6047 IN THE CITY OF
TROY, OHIO, FROM B-2, GENERAL BUSINESS DISTRICT, AND ADOPTING A PLANNED
DEVELOPMENT

COMMENTS OF MAYOR. Mayor Jenkins commented: 1) A visit from Troy's Sister
City - Takahashi City, Japan - Aug. 25/28, went well and he thanked all
involved in helping with the delegation and thanked Joyce Rieves and DP&L
for hosting an event for the Takahashi City delegation. 2) The final Troy
Community Band concert, held 9-2, was well attended. 3) The Park
Board/Department is to be congratulated for opening a new 1.75 mile section
of bike path. 4) The DARE/School Resource Officer program sponsored a "back
to school bash" on 9-1 that was well attended by students.
COMMENTS OF SERVICE & SAFETY DIRECTOR. Mr. Anderson commented: 1) Planner I
William Lutz, hired 9-3-02, was introduced. 2) Gifts from Takahashi City,
Japan to the City of Troy were displayed. 3) At the last meeting, a citizen
raised concerns about the truck traffic in the SE section, and he has met
with staff and is reviewing a proposal to help regulate such traffic.

COUNCIL COMMENTS:
-Mrs. Baker echoed the Mayor's comments about the back to school bash and
stated she would have liked to see more advance publicity on the event.
-Mr. Wise commented that at the next meeting the outgoing members of the
Youth Council will be recognized and the new members introduced.
Regarding the next phase of the sidewalk program, Council commented:
-Mr. Beamish asked if there will be an appeal process, and was advised as
this is replacing sidewalks in bad condition, there is not an appeal
process.
-Mrs. Saxton asked about the least costly way to make repairs, and was
advised that if owners have small blocks of concrete to be replaced, it
could be best for a number of such owners to go together and hire a
contractor.
-Mrs. Baker asked if trees that must be removed will be marked before the
concrete work starts, and the City Engineer advised those trees will be
marked before official notification is made to repair sidewalks.
-Mrs. Baker asked why all sidewalks in the City have not been marked, and
Mr. Anderson stated that there is not sufficient staff to mark the entire
City, but at all times it is the duty of the property owner to make repairs
to sidewalks and the property owner can proceed to do so without the
sidewalk being marked by the City.
-Mr. Mercer suggested some allowance be made regarding having all slate
sidewalks replaced as while they may become slick when wet, not all may be
in poor condition. Mr. Anderson stated that while safety must be the first
concern, he would look into this. The City Engineer commented that Miami
County was required to replace their slate sidewalks on Main Street when all
sidewalks on that street were required to be improved a few years ago.
-Mr. Bretland asked if curbs in poor condition will be replaced at the same
time as the sidewalks, and was told curbs are not part of this program, but
it may be addressed after most of the sidewalks have been repaired.
AUDIENCE COMMENTS: Thomas Robinson, 1823 Peters Road, one of the property
owners of the recently approved Goodrich-Robinson Annexation, thanked
Council for approving that annexation and stated he is pleased that his
property is now part of the City.
