| January 5, 2004 MINUTES OF COUNCIL A regular session of Troy City Council was held Monday, January 5, 2004, at 7:00 p.m. in Council Chambers. (note – Oath of office administered to Beamish, Baker, Clark, Cultice, Hutchinson, Mercer, Saxton, Dixon in December 2003. Oath administered to Lohrer, Helmer and Wise prior to this Council meeting.) Members Present: Baker, Clark, Cultice, Hutchinson, Mercer, Saxton and Wise. Presiding Officer: William F. Lohrer, President of Council Others Present: Michael L. Beamish, Mayor David E. Anderson, Director of Public Serviced & Safety W. McGregor Dixon, Jr., Director of Law R. Craig Helmer, Auditor The invocation was given Rev. Dr. James Wilson II, Senior Pastor of the First United Methodist Church. A motion was made by Mr. Mercer, seconded by Mrs. Saxton, that Sue G. Knight be employed as Clerk of Council at an annual salary of $3,600. ORDINANCE NO. O-1-04 ORDINANCE EMPLOYING CLERK OF COUNCIL AND FIXING COMPENSATION. This Ordinance was given first title reading. Mrs. Saxton moved for suspension of rules requiring three readings. Motion seconded by Mr. Cultice. Yes: Clark, Cultice, Hutchinson, Mercer, Saxton, Wise and Baker. No: None. Mrs. Baker moved for adoption. Motion seconded by Mr. Mercer. Yes: Cultice, Hutchinson, Mercer, Saxton, Wise, Baker and Clark. No: None. ORDINANCE ADOPTED The Director of Law administered the Oath of Office to Clerk of Council Sue Knight. ELECTION OF PRESIDENT OF COUNCIL PRO TEM: Following motion of Mr. Cultice, seconded by Mrs. Saxton, Mr. Mercer was elected President of Council Pro Tem by unanimous roll call vote. ELECTION OF CLERK OF COUNCIL PRO TEM: Following motion of Mr. Wise, seconded by Mr. Mercer, Mrs. Saxton was elected Clerk of Council Pro Tem by unanimous roll call vote. MINUTES: The Clerk gave a summary of the December 15, 2003 meeting of Council. There were no corrections or additions, and upon motion of Mrs. Saxton, seconded by Mr. Clark, these minutes were approved by unanimous roll call vote. January 5, 2004 p.2 COMMITTEE REPORTS: LAW & ORDINANCE COMMITTEE: Mrs. Saxton, Chairman, reported as follows: 1) Committee recommends legislation be prepared to accept the final plat of Stonebridge Estates Section 2, including dedication of right-of-way. 2) Committee recommends legislation be prepared to accept the final plat of Oakmont Creek Subdivision Section 5, dedicating right-of-way, and accepting the payment of fees in lieu of dedicated green space. Committee also recommends legislation be prepared vacating a portion of Oakmont Drive and accepting fees in lieu of dedicated green space for the Villages of Concord Condominiums. R-1-04 RESOLUTION AUTHORIZING THE DIRECTOR OF PUBLIC SERVICE AND SAFETY OF THE CITY OF TROY, OHIO TO ENTER INTO AN AGREEMENT WITH THE MIAMI COUNTY PUBLIC DEFENDER’S COMMISSION FOR 2004 This Resolution was given first title reading. O-58-03 AN ORDINANCE AMENDING SECTIONS 913.01 (a), 913.08, 915.10 (b) AND (c), OF THE CODIFIED ORDINANCES OF THE CITY OF TROY, OHIO RELATING TO WATER AND SEWER RATES, AND ADOPTING SECTION 915.10 (m) OF THE CODIFIED ORDINANCES OF THE CITY OF TROY, OHIO. ORDINANCE ADOPTED COMMENTS OF THE MAYOR: Mayor Beamish commented: 1) He appreciates the support he has received as he has transitioned from Member of Council to Mayor. 2) Mayor Peter Jenkins has submitted his final annual report. (Copy attached to original minutes.) 3) A public open house was held for former Mayor Jenkins on Jan. 4. 4) Richards Chapel is sponsoring a Martin Luther King Celebration on Jan 19. 5) He has made the following reappointments - Mary Catherine Rozell to the Recreation Board and Robert Counts to the Civil Service Commission. COMMENTS OF SERVICE & SAFETY DIRECTOR: Mr. Anderson commented: 1) The Miami Valley Regional Planning Commission has selected Troy as one of eight communities to participate in their Walkable Communities Workshop to help make the selected communities more accessible and attractive for pedestrian traffic. 2) The Dayton Gems junior hockey league that had been using Hobart Arena is gone bankrupt and the players dispersed. It is hoped that another team can be attracted to Troy next year. 3) The Dayton Bombers Hockey team will play a game at the Hobart Arena on Jan. 28. 4) At the request of Mr. Anderson, Chief Phelps stated the Police Dept. has received a grant from the U S Army that will provide the City surveillance equipment that costs about $8,000, plus extensive free training on the use of the equipment. DIRECTOR OF LAW COMMENTS: Mr. Dixon presented his annual report. (Copy attached to original minutes.) Mr. Dixon encouraged Council to provide any suggested changes to the Rules of Council. COUNCIL COMMENTS: -Mr. Clark congratulated Chief Phelps on obtaining the grant. He also commented that he feels making Troy more user friendly for pedestrians is very good.
