| February 17, 2004 MINUTES OF COUNCIL A regular session of Troy City Council was held Tuesday, February 17, 2004, at 7:00 p.m. in Council Chambers. Members Present: Baker, Clark, Cultice, Hutchinson, Mercer, Saxton and Wise. Presiding Officer: William F. Lohrer, President of Council Others Present: Michael L. Beamish, Mayor David E. Anderson, Director of Public Service & Safety W. McGregor Dixon, Jr., Director of Law R. Craig Helmer, Auditor INVOCATION was given by Rev. Pascal. MINUTES: The Clerk gave a summary of the February 2, 2004 meeting of Council. There were no corrections or additions, and upon motion of Mrs. Saxton, seconded by Mr. Clark, these minutes were approved by unanimous roll call vote. COMMITTEE REPORTS: BUILDINGS, STREETS & SIDEWALKS COMMITTEE: Mrs. Baker, Chairman, reported that Committee recommends emergency legislation be prepared as the final consent for the Ohio Dept. of Transportation improving/ paving SR 55 from the area of Kroger’s to Andy’s Garden (except for the bridge area) in 2004 with the City paying 20% of the cost ($89,540). LAW & ORDINANCE COMMITTEE: Mrs. Saxton, Chairman, gave an oral report that notice from the Ohio Department of Liquor Control has been received regarding: 1) Transfer of the existing liquor permit for Cassanos, Inc. from the address of 414 W. Main to 1201 Experiment Farm Road. 2) New C1 Permit for Wal Mart Supercenter, 1801 W. Main. UTILITIES COMMITTEE: Mr. Mercer, Chairman, reported as follows: 1) Committee recommends legislation be prepared authorizing payment to the Dayton Power & Light Company in the amount of $65,000 for electrical work associated with the generator project at the Wastewater Treatment Plant. 2) Committee recommends legislation be prepared authorizing bidding for the repainting of two of the four clarifier basins at the Water Treatment Plant at a cost not to exceed $320,000. R-9-04 RESOLUTION AUTHORIZING THE DIRECTOR OF PUBLIC SERVICE AND SAFETY OF THE CITY OF TROY, OHIO TO ADVERTISE FOR BIDS AND ENTER INTO A CONTRACT FOR THE REPAINTING OF TWO OF THE FOUR CLARIFIERS (BASINS) AT THE WATER TREATMENT PLANT This Resolution was given first title reading. R-10-04 FINAL RESOLUTION AUTHORIZING THE IMPROVEMENT OF STATE ROUTE 55 WITHIN THE CITY OF TROY, BY THE OHIO DEPARTMENT OF TRANSPORTATION, AUTHORIZING THE PAYMENT OF TROY’S SHARE OF THE PROJECT, AND AUTHORIZING THE DIRECTOR OF PUBLIC SERVICE AND SAFETY OF THE CITY OF TROY, OHIO TO EXECUTE RELATED DOCUMENTS, AND DECLARING AN EMERGENCY This Resolution was given first title reading. RESOLUTION ADOPTED COMMENTS OF THE MAYOR: Mayor Beamish commented: 1) February is Black History Month and Council has been invited to a program at Cookson School in this regard. 2) On Feb. 13, he participated in a farewell to some members of the military being deployed overseas, one of whom was a Troy Police Officer. 3) Students of a Hook School fourth grade class have prepared brochures of what they feel important about Troy and those can be seen in the Mayor’s Office. COMMENTS OF SERVICE & SAFETY DIRECTOR: Mr. Anderson commented: 1) The Stadium contractor will be meeting with staff regarding additional corrections. 2) The Civil Service Commission will be testing for Police Captain, Sergeant and entry level officers. AUDIENCE COMMENTS: Jerry Stichter, 467 W. Staunton Road, thanked the City for putting his mail box back up after it had inadvertently been knocked over during snow plowing. Frieda Iddings, 40 Elmwood, stated she understood Astronaut Col. Nancy Currie recently saw the signs announcing that Troy, Ohio is her home town, and she was proud of the signs. In regard to a question of when the Safety & Health Committee will be meeting regarding the request to consider Troy restaurants being no smoking, Mr. Hutchinson stated that meeting will take place on March 16 at 4 p.m. A motion was made by Mr. Mercer, seconded by Mr. Saxton, to recess into executive session to consider the purchase of property for a public purpose. Motion passed by unanimous roll call vote. At 7:29 p.m. Council recessed into executive session.
