| September 20, 2004 MINUTES OF COUNCIL A regular session of Troy City Council was held Monday, September 20, 2004, at 7:00 p.m. in Council Chambers. Members Present: Baker, Clark, Douglas, Hutchinson, Mercer, Saxton and Wise. Presiding Officer: William F. Lohrer, President of Council Others Present: Michael L. Beamish, Mayor W. McGregor Dixon, Jr., Director of Law Richard L. Cultice, Auditor David E. Anderson, Director of Public Service and Safety INVOCATION was given by Rev. Carol Bastin.. INTRODUCTION: New and outgoing members of the Youth Council were introduced. MINUTES: The Clerk gave a summary of the September 7, 2004 meeting of Council. There were no corrections or additions, and upon motion of Mr. Wise, seconded by Mr. Hutchinson, these minutes were approved by unanimous roll call vote. COMMITTEE REPORTS: BUILDINGS, STREET & SIDEWALKS COMMITTEE: Mrs. Baker, Chairman, gave the oral report that Committee heard comments from residents in the SW Historic District at a recent meeting and Committee has asked staff to revise the information provided to residents regarding tree removal to provide more clarity, shorten the time between making a home owner aware that a tree will be removed and actually doing that work, and confirm that the City only pays for the removal of curb lawn trees and only when there is a causal effect between an existing tree and sidewalk damage. Mrs. Baker also commented that Committee discussed a garage demolition program and asked to see the guidelines and requested more information from staff on the suggestion for the clean up of some Ordinance language. LAW & ORDINANCE COMMITTEE: Mr. Mercer reported as follows: 1) Committee recommends Ordinance No. O-37-04, acceptance of the Zwiebel Annexation, 2.415 acres between McKaig and SR 718, be approved. 2) Committee recommends legislation be prepared to accept the Collett Annexation, 0.784 acres at 1588 McKaig Road. Mr. Mercer further commented that both annexations were by petition of the individual property owners. Reports signed by Mercer, Wise and Saxton. PERSONNEL COMMITTEE: Mr. Clark, Chairman, reported that Committee recommends legislation be prepared adjusting the salary of the City Hall Custodian to a range of $13.96-$15 per hour, without longevity, when the position is next filled, with the legislation submitted as an emergency measure so the position can be posted. Mrs. Baker asked if the proposed wage is in line with that paid the Police Department Custodian and Mr. Anderson stated it is lower than the Police Department Custodian salary. O-8-04, APPROPRIATING FUNDS NECESSARY FOR THE VARIOUS DEPARTMENTS AND OFFICES OF THE CITY OF TROY, OHIO AND DECLARING AN EMERGENCY This Ordinance was given first title reading. Mr. Douglas moved for suspension of rules requiring three readings. Motion seconded by Mr. Hutchinson. Yes: Clark, Hutchinson, Wise, Douglas, Mercer, Saxton and Baker. O-40-04 ORDINANCE AMENDING ORDINANCE NO. O-64-03 REGARDING THE SALARY OF THE CITY HALL CUSTODIAN AND DECLARING AN EMERGENCY This Ordinance was given first title reading. Mr. Clark moved for suspension of rules requiring three readings. Motion seconded by Mr. Hutchinson. Yes: Wise, Douglas, Mercer, Saxton, Baker, Clark and Hutchinson. No: None Mrs. Saxton moved for adoption. Motion seconded by Mr. Wise. Yes: Douglas, Mercer, Saxton, Baker, Clark, Hutchinson and Wise. No: None. ORDINANCE ADOPTED COMMENTS OF MAYOR: Mayor Beamish noted that Council member Saxton is a recipient of the YWCA Women of Excellence Award in recognition of her contribution to the community. COMMENTS OF SERVICE & SAFETY DIRECTOR: Mr. Anderson commented that Water Plant Superintendent John Shaffer is the recipient of the 2004 Operator Meritorious Award from the American Water Works Association. AUDIENCE COMMENTS: Michael Burkholder, 465 W. Staunton Road, asked if he can be cut off if Council does not like what he says. Mr. Dixon stated he cannot respond without knowing what will be said. Mr. Burkholder then stated that the architect’s sign at the aquatic center site reads Staunton “Avenue” and not “Road”. EXECUTIVE SESSION. A motion was made by Mr. Clark, seconded by Mr. Mercer, to recess into executive session to consider the purchase of property for a public purpose. Motion passed by unanimous roll call vote. At 7:35 p.m. Council recessed into Executive Session.
