| February 22, 2005 MINUTES OF COUNCIL A regular session of Troy City Council was held Monday, February 22, 2005, at 7:00 p.m. in Council Chambers. Members Present: Baker, Douglas, Hutchinson, Saxton and Wise. Upon motion of Mrs. Baker, seconded by Mrs. Saxton, Mr. Clark was excused from this meeting by unanimous roll call vote Upon motion of Mrs. Baker, seconded by Mrs. Saxton, Mr. Mercer was excused from this meeting by unanimous roll call vote Presiding Officer: William F. Lohrer, President of Council Others Present: Michael L. Beamish, Mayor Richard L. Cultice, Auditor David E. Anderson, Director of Public Service and Safety INVOCATION was given by Rev. Carpenter of St. John’s United Church of Christ. PUBLIC HEARING. At 7:05 p.m., Mr. Lohrer declared open a public hearing on R-12-05, application of Harold Hines continuing to have 25.145 acres of land remain in an agricultural district. There were no comments in this regard, and at 7:06 p.m., Mr. Lohrer declared this hearing closed. PRESENTATIONS: Andy Voltava, member of the Board of Directors of the Ohio City/County Management Association, presented Troy with the Innovation in Local Government Award for the management/assessment training program. Mr. Anderson accepted the award on behalf of the City. Police Chief Phelps and Fire Chief Denney commented on how well the training model has worked for their departments. EMPLOYEES OF THE YEAR. Awards were presented to David Spiers (Recreation Department) and Tim Davis (Planning Department) as 2004 Employees of the Year for their dedication to their jobs. MINUTES: The Clerk gave a summary of the February 7, 2005, meeting of Council. There were no corrections or additions. Upon motion of Mrs. Baker, seconded by Mrs. Saxton, these minutes were approved by unanimous roll call vote. COMMITTEE REPORTS: Law & Ordinance Committee: Mrs. Saxton, Chairman, reported that Committee recommends legislation be prepared authorizing amendments to Enterprise Zone Agreement #27 with 3 Sigma Corporation to permit First Edition Homes, Inc. to be added to the agreement as that company will own the real estate, and to make some wording changes recommended by the County, with Committee noting there are no changes to the terms, conditions and commitments of the Agreement as previously approved. Recreation & Parks Committee: Mr. Wise, Chairman, reported: 1) Committee met to again review the types of chairs to be bid for the Troy Aquatic Park, and recommends that Council proceed to adopt the R-6-05 authorizing bidding chairs in an amount not to exceed $40,000. 2) Committee recommends legislation be prepared authorizing the Director of Public Service and Safety to enter into an additional agreement with Poggemeyer Design Group for work on the Stadium Project in an amount not to exceed $70,000 to cover work done as the City attempted to have the project completed and through the mediation process with the contractor. R-7-05 RESOLUTION AUTHORIZING THE DIRECTOR OF PUBLIC SERVICE AND SAFETY OF THE CITY OF TROY, OHIO TO ENTER INTO AN AGREEMENT WITH OHIO GOVERNMENTAL FINANCIAL MANAGEMENT, INC. This Resolution was given first title reading on February 7, 2005. Given second title reading. RESOLUTION R-10-05 RESOLUTION AUTHORIZING THE DIRECTOR OF PUBLIC SERVICE AND SAFETY OF THE CITY OF TROY, OHIO TO ENTER INTO AN AGREEMENT WITH POGGEMEYER DESIGN GROUP, INC. FOR ADDITIONAL SERVICES ASSOCIATED WITH THE STADIUM RENOVATION PROJECT AND DECLARING AN EMERGENCY. This Resolution was given first title reading. AS A PARTY TO THE AGREEMENT AND AUTHORIZING THE DIRECTOR OF PUBLIC SERVICE AND SAFETY TO EXECUTE THE AMENDMENT AND RELATED DOCUMENTS This Resolution was given first title reading. RESOLUTION R-12-05 RESOLUTION APPROVING APPLICATION OF HAROLD A. HINES TO PLACE LAND IN AGRICULTURE DISTRICT This Resolution was given first title reading. ORDINANCE NO. O-7-05 ORDINANCE AMENDING SECTION 1000.13170(e) OF THE CODIFIED ORDINANCES OF THE CITY OF TROY OHIO RELATED TO CHANGEABLE COPY SIGNS This Ordinance was given first title reading. ORDINANCE NO. O-8-05 ORDINANCE CHANGING THE ZONING OF INLOT 9304 IN THE CITY OF TROY, OHIO FROM COUNTY A-1 AND A-2 ZONING AND ADOPTING A PLANNED DEVELOPMENT This Ordinance was given first title reading. ORDINANCE NO. O-9-05 AN ORDINANCE AMENDING SECTION 935.12 OF THE CODIFIED ORDINANCES OF THE CITY OF TROY, OHIO RELATED TO INDIGENT BURIAL This Ordinance was given first title reading. COMMENTS OF MAYOR: The Mayor noted future community events, including the First Lutheran Church Day of Caring, the Library sponsored “Big Read” (4-7) and the annual Prayer Breakfast (3-19). COMMENTS OF DIRECTOR OF PUBLIC SERVICE AND SAFETY: Mr. Anderson commented: On Feb. 23 the elected officials of some Miami Valley cities are holding a rally at Memorial Hall regarding the State’s proposed inroads to using the Local Government Funds, and there are media stores of a pornographic operation buying Hollywood Video stores (one such store is in Troy). February 22, 2005 Page Three COMMENTS OF COUNCIL: -Mrs. Saxton noted that Council had received a copy of the logo for the Troy Aquatic Park approved by the Recreation Board. AUDIENCE COMMENTS: -Troy High Student, Tiffany Carnes, invited Council to a Black History Program at the High School on 2-28. -Kent Kazmaier, 1220 W. Main, complimented the City for the snow handling this winter, but suggested plowing snow to the center of a street would avoid plowing drives shut and covering sidewalks with plowed snow, especially on W.
