| June 19, 2006 MINUTES OF COUNCIL A regular session of Troy City Council was held Monday, June 19, 2006, at 7:00 p.m. in Council Chambers. Members Present: Baker, Clark, Douglas, Harrah, Kendall, Mercer and Saxton. Presiding Officer: William F. Lohrer, President of Council Others Present: Michael L. Beamish, Mayor Arthur D. Haddad, Interim Director of Public Service and Safety W. McGregor Dixon, Jr., Director of Law Richard L. Cultice, Auditor INVOCATION: An invocation was given by Council Member Clark. MINUTES: The Clerk gave a summary of the June 5, 2006, meeting of Council. There were no corrections or additions to these minutes. Upon motion of Mr. Harrah, seconded by Mr. Clark, the minutes were approved by unanimous roll call vote. COMMITTEE REPORTS: Buildings, Streets & Sidewalks Committee: Mr. Douglas, Chairman, reported as follows: 1) Committee recommends the Ordinance of Assessment for Phase III of the sidewalk replacement program be prepared. It was noted that no objections have been received in response to the Notice of the Assessments. 2) Committee received an update that there will be an oil trap installed on the floor drain lines in the cold storage building at the Water Plant, at a cost of $4,167. This work is within the project authorization and no additional legislative action is required. Reports signed by Clark, Kendall and Douglas. Finance Committee: Mr. Mercer, Chairman, reported that Committee recommends emergency legislation be prepared estimating the aggregate maximum amount of public funds for deposits to be $1,000 in inactive deposits, $10,000,000 in active deposits, and $50,000,000 in interim deposits. Committee noted that the uniform depository process must be done every five years, the current agreements expire in August, and another piece of legislation will be considered to award the deposits following the completion of the depository process. R-32-06 RESOLUTION PROVIDING FOR THE SUBMISSION TO THE ELECTORS OF THE CITY OF TROY AT THE NEXT GENERAL ELECTION THE QUESTION OF FOUR YEAR STAGGERED TERMS FOR COUNCIL MEMBERS OF THE CITY OF TROY AND A FOUR YEAR TERM FOR THE PRESIDENT OF COUNCIL OF THE CITY OF TROY, OHIO This Resolution was given first title reading on June 5, 2006. Given second title reading. RESOLUTION NO. R-33-06 RESOLUTION AUTHORIZING THE DIRECTOR OF PUBLIC SERVICE AND SAFETY OF THE CITY OF TROY, OHIO TO FILE AN APPLICATION FOR THE USE OF COMMUNITY DEVELOPMENT GRANT FUNDS This Resolution was given first title reading. O-24-06 ORDINANCE LEVYING ASSESSMENTS FOR PHASE III OF THE SIDEWALK IMPROVEMENT PROGRAM This Ordinance was given first title reading. Mr. Clark moved for adoption. Motion seconded by Mr. Douglas. Yes: Saxton, Harrah, Douglas, Baker, Clark, Mercer and Kendall. No: None. ORDINANCE ADOPTED COMMENTS OF MAYOR. The Mayor commented: - In recent weeks, hundreds of persons have visited Troy to attend events, made positive comments, especially about the downtown and the flowers, and contributed to the economy. - His next open forum at the Senior Citizens Center will be held in September. - The Troy Development Council annual report has been published and distributed. COMMENTS OF INTERIM DIRECTOR OF PUBLIC SERVICE AND SAFETY. Mr. Haddad noted: - Staff is researching some solution to the fence issue raised at the last meeting. - At the last meeting there were comments about storm water at Pamela Estates. Staff met with Mr. Marshall (who made the comments) the next day, and he is satisfied with the response. Staff continues to look into this area. - A comment was made at the prior meeting about the new restrooms at the Barn in the Park being locked. That locking was through a misunderstanding by persons associated with the children’s summer theatre program and has been corrected. Regarding accessibility, there will be a report by the next meeting. COMMENTS OF COUNCIL. - Mr. Harrah thanked Mr. Haddad for all the information received providing updates. - Mr. Mercer asked about sidewalks on S. Dorset where none have been, and asked when these “infill” areas may receive sidewalks. The Public Works Director said those areas without sidewalks have been planned to be considered after all the sidewalks that need to be, have been repaired. - Mrs. Baker welcomed the Grainger Company, which opened today. - Mrs. Baker asked about how the number of water main breaks compares to prior years and is there any way to prevent some of the breaks. Mr. Leffel, Public Works Director, stated that the highest number of breaks in a year was 33, with the low number in the low 20s. Mr. Leffel further noted that the ones that usually break are cast iron water mains, some of which date to the late 1800s. He said they will break at times when there is ground movement associated with moisture. Mr. Haddad stated there is no way that water lines can be inspected as they are constantly flowing water and are about 4.5 foot deep. Mr. Haddad further commented that with the number of miles of lines, there will be some breaks. - Mr. Clark stated he was glad to give the invocation as he feels strongly about the hard work of the employees and volunteers. Mr. Clark commented that retired firefighter Jim Miller passed away. - Mrs. Saxton stated that some new trees planted in the Westbrook area have died. Mr. Mercer commented that some were planted in June last year, which is not a good time for planting new trees, and are scheduled to be replaced in the fall. June 19, 2006 Page Three COMMENTS OF AUDIENCE: - Michael Burkholder, 465 W. Staunton Road, asked about televising of Council meetings. Mr. Lohrer stated this matter has been considered by Council in the past. Mrs. Saxton stated she has not supported televising, but supports the meetings being live on radio. Mr. Burkholder said he did not know the financial impact of televising, the Board of Education’s meetings are televised, and he feels televising would be preferable from radio as there are times there may be a need for people to see body language and facial expressions. Mrs. Baker asked that the issue of televising Council meetings again be discussed by Council as a Committee of the Whole. Mr. Lohrer said that would be assigned. - Debra Stichter, 467 W. Staunton Road, asked if the funds spent on the Lincoln Community Center have resulted in the facility the City wants. She suggested the Mayor hold a public forum at the Center. Mrs. Stichter asked who is responsible for the high school and stadium sidewalks and when will they be repaired. Mr. Leffel commented the high school is the Board of Education’s responsibility and that at the stadium/Arena sidewalks are the responsibility of the City. Mr. Haddad commented that certain criteria is needed to replace a sidewalk, and that the criteria would be more than a cracked sidewalk. - Lester Conard, 1210 S. Clay Street, reported that some new handicap ramps in Westbrook have cracked, with those at Cornish and Trade Square as examples. Mr. Conard also commented that some areas of the sidewalk in front of City Hall are getting worse again. - Trevor Stutz, 123 S. Dorset, asked if the City is allowed to mow the Hobart Urban Nature Preserve. Mr. Haddad stated that park is owned by the Miami County Park District and they have total control over all activities and maintenance of that park. PRESENTATION. Tom Kirkham, Chairman of the National Night Out event, announced that the event will be held the evening of August 1 In the Community Park, and stated there will be activities for all ages. Mr. Clark noted that Mr. Kirkham and many volunteers work hard to make the event a success.
