| August 21, 2006 MINUTES OF COUNCIL A regular session of Troy City Council was held Monday, August 21, 2006, at 7:00 p.m. in Council Chambers. Members Present: Baker, Clark, Douglas, Harrah, Kendall, Mercer and Saxton. Presiding Officer: William F. Lohrer, President of Council Others Present: Michael L. Beamish, Mayor Arthur D. Haddad, Interim Director of Public Service and Safety W. McGregor Dixon, Jr., Director of Law Richard L. Cultice, Auditor INVOCATION: An invocation was given by Council Member Saxton. MINUTES: The Clerk gave a summary of the August 7, 2006, meeting of Council. There were no corrections or additions to these minutes. Upon motion of Mrs. Baker, seconded by Mrs. Saxton, the minutes were approved by unanimous roll call vote. COMMITTEE REPORTS: Buildings, Streets & Sidewalks Committee: Mr. Douglas, Chairman, reported as follows: 1) Committee recommends legislation be prepared authorizing bidding of roof repairs and improvements at the Lincoln Community Center at a cost not to exceed $175,500, with the funding from the City’s CDBG allocation. 2) Committee recommends legislation be prepared to amend fines for violations of parking meters and 2-hour parking spaces as follows From: $5 for parking violation if paid within 24 hours; $10 after 24 hours; $25 parking violation for handicapped zones; Re-ticket if the violation continues Proposed: $10 for parking violation if paid within 48 hours; $25 if after 48 hours; $50 parking violation for handicapped zones, plus the ability to tow immediately; Re-ticket if the violation continues It was also recommended that all fees be reviewed after 12 months. R-41-06 RESOLUTION AUTHORIZING THE DIRECTOR OF PUBLIC SERVICE AND SAFETY OF THE CITY OF TROY, OHIO TO ADVERTISE FOR BIDS AND ENTER INTO CONTRACTS FOR THE USE OF COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS ALLOCATED TO THE LINCOLN COMMUNITY CENTER This Resolution was given first title reading. Mr. Clark moved for suspension of rules requiring three readings. Motion seconded by Mr. Douglas. Yes: Mercer, Saxton, Clark, Kendall, Baker, Harrah and Douglas. No: None. Mr. Kendall moved for adoption. Motion seconded by Mr. Harrah. Yes: Saxton, Clark, Kendall, Baker, Harrah, Douglas and Mercer. No: None. RESOLUTION ADOPTED ORDINANCE NO. O-27-06 ORDINANCE AMENDING CHAPTER 1501 OF THE CODIFIED ORDINANCES OF THE CITY OF TROY REGARDING THE OHIO FIRE CODE This Ordinance was given first title reading on July 24, 2006. Given second title reading on August 7, 2006. Given third title reading. Mr. Harrah moved for adoption. Motion seconded by Mrs. Baker. Yes: Clark, Kendall, Baker, Harrah, Douglas, Mercer and Saxton. No: None. ORDINANCE ADOPTED 8-21-06 Page Two ORDINANCE NO. O-29-06 AN ORDINANCE AMENDING SECTION 351.99 OF THE CODIFIED ORDINANCES OF THE CITY OF TROY, OHIO RELATED TO PARKING FINES This Ordinance was given first title reading. PRESENTATION: Chuck Fox, Executive Director of Troy Main Street, provided a summary of the activities of Troy Main Street, noting that the summer concert series has been well attended and that a number of events are planned to the end of the year. He also commented that the first Troy Classic on the Square (bicycle race) may not have met all the objectives, but it was planned to continue the event in 2007, with it possibly moved to a Sunday. Mr. Fox noted that the 2007 “Sculptures on the Square” event would be of Waco plane replicas that individuals would paint/decorate and the planes would then be sold. Mrs. Baker asked if the official group that ran the Troy Classic have agreed to a Sunday date and Mr. Fox stated that is still being worked on. Mrs. Saxton asked about the Festival of Nations event, with Mr. Fox commenting that it was well attended. Mr. Mercer asked how many vacant store fronts there are. Mr. Fox stated there are five on Main or Market Streets, and there is interest in most of the locations. Mr. Clark noted that there is cooperation between the Mayor’s Round Table (focus on the downtown) and Troy Main Street. Mr. Fox stated the farmers’ market is being suspended for the summer, but will start at the beginning of the season next year. COMMENTS OF MAYOR. The Mayor’s comments included: - Thanked Chuck Fox and Troy Main Street for all they do to promote the downtown area. - Read a letter from the Dayton Business Journal announcing that the Troy Aquatic Park received an honorable mention in the publication’s first-ever Structures Awards program. - The Festival of Nations (Aug. 19) and Mayors Concert (Aug. 20) were well attended. The Mayor thanked all the volunteers that worked on those two events and the number of City staff members who worked to facilitate the events. - The WACO fly-in will be held the coming weekend. COMMENTS OF INTERIM DIRECTOR OF PUBLIC SERVICE AND SAFETY. Mr. Haddad commented that Council had received information about the progress of new Fire Station 2, the status of storm damage repairs at Lincoln Community Center, procedures/checklists for processing/handling of developments and projects, and how speed limits are established. COMMENTS OF COUNCIL. - Mr. Harrah asked if there are or can be procedures for parking of oversize vehicles in the diagonal parking spaces, noting that it seems some lanes shifted near the post office with the new paving. Mr. Haddad will provide a response. - Mrs. Saxton thanked Mr. Haddad for all the information he is providing Council. - Mrs. Baker noted that the Wall Street Journal reported on the Hobart Institute of Welding Technology, and advised that the Institute will have a record number of students in the fall. - Mrs. Baker asked about SR 55, and other areas that the State orange construction signs are still up; and will they be removed. Mr. Haddad will provide a response. Steve Leffel stated that ODOT has been asked about the width of the lanes, and there is some work yet to be done by the ODOT contractor (i.e., crack sealing) before the signs will be removed. Mr. Clark asked if brush pickup from the last storm has been completed. Mr. Leffel stated that it is hard to identify the origin of all brush, but he believes most of the items from the storm damage have been removed. AUDIENCE COMMENTS. Charles Davis, 605 Indiana Avenue, stated there is junk on a porch at 607 Indiana Avenue, which is a rental property, and other porches that contain a lot of trash. staff has told him nothing can be done based on current regulations, and he feels people support referendums on development because of porch trash. Mr. Davis suggested there be an ordinance that dictates only what citizens can have on a porch. He also commented that there is a sunken area on Peters. 8-21-06 Page Three Jean Melvin, 25 N. Walnut, thanked Mr. Harrah for pulling weeds in areas between Walnut Street and the Square, in an alley, and from a railroad area.
