MINUTES OF COUNCIL


A regular session of Troy City Council was held Tuesday, January 2, 2007, at 7:00 p.m. in Council Chambers.

Members Present: Baker, Clark, Douglas, Harrah, Kendall, Mercer and Saxton.

Presiding Officer: William F. Lohrer, President of Council

Others Present: Michael L. Beamish, Mayor
Patrick E. J. Titterington, Director of Public Service and Safety
Richard L. Cultice, City Auditor
W. McGregor Dixon, Jr., Director of Law

INVOCATION: An invocation was given by Rev. James Wilson of the First United Methodist Church.

PUBLIC HEARING: At 7:02 p.m. Mr. Lohrer declared open a public hearing on Ordinance No. O-2-2007. There were no comments in this regard, and at 7:03 p.m. Mr. Lohrer declared this public hearing closed.


MINUTES: The Clerk gave a summary of the minutes of the December 18, 2006, meeting of Troy City Council. There were no corrections or additions to those minutes. A motion was made by Mr. Harrah, seconded by Mr. Clark, to approve the minutes. Motion passed by unanimous roll call vote.


COMMITTEE REPORTS:
SAFETY & HEALTH COMMITTEE. Mr. Harrah, Chairman, reported that Committee recommends legislation be prepared to increase ambulance fees commensurate with the 2007 Medicare reimbursement for such services as follows:
Basic Life Support (BLS) $361
Advanced Life Support (ALS) #1 $730
Advanced Life Support (ALS) #2 $803
Loaded Mile Charge $10.25

RESOLUTIONS – NONE

ORDINANCE NO. O-54-06
AN ORDINANCE REPEALING CHAPTER 555 OF THE CODIFIED ORDINANCES OF THE CITY OF TROY, OHIO, REGARDING SMOKING IN MUNICIPALLY OWNED FACILITIES.

This Ordinance was given first title reading on Dec. 18, 2006.
Given second title reading.


ORDINANCE NO. O-1-2007
AN ORDINANCE AMENDING SECTION 1509.02 OF THE CODIFIED ORDINANCES OF THE CITY OF TROY, OHIO CONCERNING EMERGENCY AMBULANCE FEES

This Ordinance was given first title reading.

A motion was made by Mrs. Baker to suspend the rules requiring three readings. Motion seconded by Mr. Harrah.
Yes: Mercer, Saxton, Kendall, Baker, Harrah, Douglas and Clark.
No: None.
Mr. Harrah moved for adoption. Motion seconded by Mrs. Baker.
Yes: Saxton, Kendall, Baker, Harrah, Douglas, Clark and Mercer.

ORDINANCE NO. O-2-2007
AN ORDINANCE AMENDING SECTIONS 1000.12970(I), 1000.13170(O), 1000.13170(U), AND 1000.14810 TABLE S-2 OF THE CITY OF TROY, OHIO ZONING CODE REGARDING PARKING AND SIGNS

This Ordinance was given a public hearing.
This Ordinance was given first title reading.


COMMENTS OF THE MAYOR. The Mayor distributed his 2006 annual report, commenting that it was a highlight synopsis of the many events and activities involving the Mayor and his role in our community during the past year.
(A copy of the Mayor’s report will be attached to the original minutes.)
The Mayor noted that a number of local events have been planned in memory and honor of Dr. Martin Luther King, Jr.

COMMENTS OF THE DIRECTOR OF PUBLIC SERVICE AND SAFETY. (Patrick E. J. Titterington was appointed Director of Public Service and Safety effective January 1, 2007, and took the Oath of Office on January 2.) Mr. Titterington stated he will he meeting with Council Members and Department Heads in the coming weeks and months, and that he looks forward to his tenure in Troy.

COUNCIL COMMENTS
-Mrs. Baker stated she enjoyed the First Night (Dec. 31) activities.
-Mr. Clark and Mr. Harrah commented that there have been three new command appointments in the Fire Department. Mr. Harrah noted that with the new fire command staff and the appointment of the Director of the Public Service and Safety, 2007 is a year of new beginnings for Troy.

STAFF COMMENTS: Newly appointed Fire Chief Christopher Boehringer introduced two other new command members - Assistant Chief Matt Simmons and Platoon Commander Kristopher Alexander. Assistant Chief Simmons stated that the Fire Department goal is to align the Fire Department goals and visions with that of the City Council and administration.

AUDIENCE COMMENTS
-Debra Stichter, 467 W. Staunton Road, asked if the Mayor’s Annual Report could be added to the web site. It was indicated this will be done.
-Rev. James Wilson, thanked the City and Fire Department for the outstanding responses to calls from the Methodist Church during the past year, particularly for the quick response to the fire that devastated their “First Place” structure. He thanked the Fire Department for saving the building. In a final comment, Rev. Wilson noted that renovation of First Place, including a full roof replacement, will start in the coming weeks. The City rents parking spaces for City Hall employees from the church, and those employees will need to find alternate parking for the approximately 30 days of renovation.
