MINUTES OF COUNCIL, SPECIAL MEETING

A special session of Troy City Council was held Tuesday, October 9, 2007, at 5:30 p.m. in Council Chambers.

Members Present: Baker, Clark, Douglas, Harrah, Kendall, Mercer and Saxton.

Presiding Officer: Ted S. Mercer, President of Council Pro Tem

Others Present: Michael L. Beamish, Mayor
W. McGregor Dixon, Jr., Director of Law
Richard L. Cutlice Auditor

The Notice of Special Meeting of City Council was read and signed, noting that the meeting was called for the purpose of recessing into executive session to review pending court action; consideration of Ordinance No. O-50-2007. (original Notice attached to original minutes)


EXECUTIVE SESSION. A motion was made by Mr. Kendall, seconded by Mr. Harrah, that Council recess into executive session to review pending court action Motion passed by unanimous roll call vote. At 5:32 p.m. Council recessed into executive session. At 6:01 p.m. Council returned from executive session and continued the meeting.

COMMENTS ON AGENDA ITEMS. Lester Conard, 1210 S. Clay Street, asked for more information as to the reason for the special meeting. Mr. Dixon, Director of Law, commented that if a zoning request is not acted on within 90 days of when received by Council, the zoning request is deemed denied. Ordinance No. O-50-2007 is a matter of a zoning change. The 90 days would expire prior to the next regular meeting of Council. The special meeting was called so that Council could have an opportunity to act on the Ordinance if it wished to do so.

AN AMENDED ORDINANCE CHANGING THE ZONING OF INLOT 9304 IN THE CITY OF TROY, OHIO FROM MIAMI COUNTY ZONING A-1, DOMESTIC AGRICULTURE DISTRICT, AND A-2, GENERAL AGRICULTURE DISTRICT, AND ADOPTING A CITY ZONED PLANNED DEVELOPMENT

This Ordinance was given first title reading on July 16, 2007.
Given public hearing and second title reading on August 6, 2007.
Given third title reading on September 4, 2007.
Given fourth title reading on September 17, 2007.
Given fifth title reading on October 1. 2007.
Given sixth title reading.

Mrs. Saxton moved for adoption. Motion seconded by Mr. Douglas.
Yes: Clark, Mercer, Douglas, Saxton and Kendall.
No: Harrah and Baker
ORDINANCE ADOPTED



There being no further business, the special meeting adjourned at 6:05 p.m.
