May 19, 2008 MINUTES OF COUNCIL A regular session of Troy City Council was held Monday, May 19, 2008, at 7:00 p.m. in Council Chambers. Members Present: Clark, Douglas, Harrah, Hutchinson, Kirkham and Schweser. Upon motion of Mr. Harrah, seconded by Mr. Schweser, Mr. Kendall was excused from this meeting by unanimous roll call vote. Presiding Officer: Martha A. Baker, President of Council Others Present: Michael L. Beamish, Mayor Patrick E. J. Titterington, Director of Public Service and Safety W. McGregor Dixon, Jr., Director of Law Richard L. Cultice, Auditor INVOCATION: An invocation was given by Council member Harrah. MINUTES: The Clerk gave a summary of the minutes of the May 5, 2008 meeting of Troy City Council. There were no corrections or additions to these minutes. A motion was made by Mr. Harrah, seconded by Mr. Hutchinson, to approve these minutes. Motion passed by unanimous roll call vote. COMMITTEE REPORTS: Law & Ordinance Committee: Mr. Douglas reported that Committee recommends Ordinance No. O-8-2008 be approved for the rezoning of parts of Inlots 123 and 128 from R-7 to M-1. Report signed by Clark and Douglas. Personnel: Mr. Clark, Chairman, reported that Committee supports a proposed reorganization and restructuring that will result in annual budgetary savings of approximately $270,000 plus about $319,000 saved in the General Fund with appropriate expenses shifted to the newly created Storm Water Utility Fund. There may be several pieces of legislation to implement the proposal, the first of which is establishing five new positions—Assistant Director of Public Service and Safety, MIS Manager, MIS Technician w/GIS, MIS Technician, and Project Manager. (copy of entire report attached to original minutes) Report signed by Harrah, Schweser and Clark. COMMENTS REGARDING COMMITTEE REPORTS OR AGENDA ITEMS. Debra Stichter, 467 W. Staunton Road, commented regarding the two Ordinances regarding sale of alcohol at the Hobart Arena. She stated she is not opposed to alcohol, but is opposed to selling alcohol within the recreation corridor and where students gather. She read information about how to object to a liquor permit. She also stated that at a prior meeting, a DARE officer had stated he did not oppose such sale as students are taught to make good decisions, and as some school officials serve on the Recreation Board (that made the recommendation regarding the sale of alcohol) she does not feel the schools will object to the proposed ordinances. Lester Conard, 1210 S. Clay Street, stated he feels the potential small revenue from the sale of alcohol at the Hobart Arena does not offset the danger from such sale. He stated he feels the Arena is a millstone and perhaps it should be turned into a parking garage. Regarding the potential cutbacks of City staff, Mr. Conard suggested there should have been more tightening in good times so there would not be such an impact now. Don Kendall, 464 Forrest Lane, stated he supports the sale of beer at the Hobart Arena, and feels it will help offset the deficit. He commented that he attends about 50 Dayton Bombers Hockey games a year, at a number of locations, all of which (other than the Hobart Arena) sell beer, and he has not seen a problem with alcohol abuse. He feels the opportunity for attendees to purchase beer will increase attendance. Jerry Stichter, 467 W. Staunton Road, commented that he understands O-9-2008 has to do with vote of citizens regarding the sale of alcohol at the Arena. He asked about O-10-2008, which amends Ordinances to allow for the sale of alcohol at the Arena. It was stated that Ordinance is needed for application for temporary permits, and that would be a permanent Ordinance unless repealed by Council. Mr. Stichter suggested there be no vote on amending the Ordinances unless the citizens voted for the sale of alcohol at the Arena. May 19, 2008 Page Two RESOLUTION NO. R-20-2008 A CORRECTING RESOLUTION TO LEVY AN ADDITIONAL ANNUAL LICENSE TAX ON ALL MOTOR VEHICLES IN THE CITY OF TROY, OHIO PURSUANT TO R.C. 4504.06 AND R.C. 4504.17 This Resolution was given first title reading. Mr. Douglas moved for suspension of rules requiring three readings. Motion seconded by Mr. Clark. Yes: Clark, Douglas, Hutchinson, Schweser, Kirkham and Harrah. No: None. O-8-2008 ORDINANCE CHANGING THE ZONING OF PARTS OF INLOTS 123 AND 128 IN THE CITY OF TROY, OHIO FROM R-7, MULTIPLE-FAMILY RESIDENCE DISTRICT TO M-2 LIGHT INDUSTRIAL DISTRICT This Ordinance was given public hearing and first title reading on May 5, 2008. Given second title reading. Mr. Clark moved for suspension of rules requiring three readings. Motion seconded by Mr. Hutchinson. Yes: Hutchinson, Schweser, Kirkham, Harrah, Clark and Douglas. O-9-2008 ORDINANCE PLACING A LOCAL LIQUOR OPTION CONCERNING A COMMUNITY FACILITY ON THE BALLOT FOR NOVEMBER 4, 2008 GENERAL ELECTION IN THE CITY OF TROY, OHIO This Ordinance was given first title reading ORDINANCE NO. O-10-2008 ORDINANCE AMENDING SECTION 933.20 OF THE CODIFIED ORDINANCES OF THE CITY OF TROY, OHIO RELATING TO THE USE OF ALCOHOLIC BEVERAGES IN PARK AREAS IN THE CITY OF TROY This Ordinance was given first title reading. ORDINANCE NO. O-11-2008 AN ORDINANCE AMENDING SECTION 521.07 OF THE CODIFIED ORDINANCES OF THE CITY OF TROY, OHIO AND ENACTING SECTION 1000.13920(G) OF THE ZONING CODE OF THE CITY OF TROY, OHIO REGARDING FENCES, VARIANCES, AND APPEALS This Ordinance was given first title reading. ORDINANCE NO. O-12-2008 ORDINANCE AMENDING ORDINANCE NO. O-49-06, AS AMENDED BY ORDINANCE NUMBERS O-40-2007 AND O-65-2007, FIXING SALARIES AND WAGES OF CERTAIN EMPLOYEES OF THE CITY OF TROY, OHIO AND DECLARING AN EMERGENCY This Ordinance was given first title reading. May 19, 2008 Page Three COMMENTS OF THE MAYOR: Mayor Beamish commented that: -May 23 is the date of the first Friday evening concert of the season on Prouty Plaza, and Mr. Harrah will be performing with the band that night. -May 25 is the first concert of the Troy Community Band. -There will be a Memorial Day Parade on May 26. COMMENTS OF THE DIRECTOR OF PUBLIC SERVICE AND SAFETY: Mr. Titterington commented that: -The apparent low bid for the Lime Sludge Lagoon cleaning contract is about $18,000 under the authorization. -The apparent low bid for SCBA equipment for the Fire Department is about $17,000 under the authorization. Most of the funding for this equipment will be paid by a grant. -The new recycling contractor has been delivering bins; if someone needs more bins contact the city. COUNCIL PRESIDENT COMMENTS. Mrs. Baker: -Thanked the companies participating in the Operation Cloverleaf project on the five year anniversary of the members of that public-private organization maintaining the interchange of SR 41 (W. Main Street) and I-75. The companies donate about $45,000 annually in materials and labor in maintaining the interchange. -Congratulated Stillwater Technologies on their 50th anniversary. COUNCIL COMMENTS: -Mr. Schweser commented that June 6-7-8 is the Troy Strawberry Festival, noting that the Festival was started 32 years ago to provide funds to support the activities of non-profit organizations. He congratulated all those associated with the Troy Strawberry Festival Soccer Tournament the past weekend that had 270 participating teams. -Mr. Harrah encouraged people to attend concerts on the Square this summer, including the first to be held May 23. -Mr. Clark also complimented and thanked the companies that are part of Operation Cloverleaf for their contribution to the community. AUDIENCE COMMENTS: -Tim Ray, 619 Orchard Drive, Water Plant employee, stated he is a representative of Local Chapter 1342 of AFSCME, and he is willing to attend any meetings where he may be of service. He stated that the union is aware of the financial problems facing the City and would like to be a part of the solution. -Martha Harris, 1875 Woodlawn, representing Troy Community Works, announced that the organization will host a public meeting on May 29, 4:30-6:30 p.m., at the Community Room to review their strategic plan.
