MINUTES OF COUNCIL

A regular session of Troy City Council was held Monday, March 2, 2009, at 7:00 p.m. in Council Chambers.

Members Present: Clark, Hutchinson, Kendall, Kirkham and Schweser.
Upon motion of Mr. Clark, seconded by Mr. Schweser, Mr. Douglas, was excused from this meeting by unanimous roll call vote.
Upon motion of Mr. Kirkham, seconded by Mr. Hutchinson, Mr. Harrah, was excused from this meeting by unanimous roll call vote.

INVOCATION: An invocation was given by Council Member Clark.

MINUTES: The Clerk of Council gave a summary of the minutes of the February 17, 2009 meeting of Troy City Council. There were no corrections or additions to these minutes. A motion was made by Mr. Clark, seconded by Mr. Schweser, to approve these minutes. Motion passed by unanimous roll call vote.

COMMITTEE REPORTS:
Finance Committee: Mr. Kendall reported as follows:
1) Committee recommends legislation be prepared to provide moderate adjustments to some of the fees charged for the sale of lots and services performed in the municipal cemeteries.
2) Committee recommends legislation be prepared authorizing submittal of an application through the MVRPC for transportation projects to be considered for funding under the Federal American Reinvestment and Recovery Act of 2009 (aka the Stimulus Plan). Due to the filing deadline, committee recommended emergency legislation.

COMMENTS REGARDING COMMITTEE REPORTS OR AGENDA ITEMS: NONE

Prior to the introduction of legislation, Council President Baker noted that with two members of Council absent, there were not sufficient members present to approve the suspension of rules requiring three readings.


RESOLUTION NO. R-14-2009
RESOLUTION AUTHORIZING THE DIRECTOR OF PUBLIC SERVICE AND SAFETY OF THE CITY OF TROY, OHIO TO SUBMIT APPLICATIONS FOR FEDERAL AMERICAN REINVESTMENT AND RECOVERY ACT OF 2009 FUNDS, THROUGH THE MIAMI VALLEY REGIONAL PLANNING COMMISSION AND DECLARING AN EMERGENCY

This Resolution was given first title reading.


ORDINANCE NO. O-27-2008
AN AMENDED ORDINANCE ADOPTING A NEW ZONING CODE FOR THE CITY OF TROY, OHIO

This Ordinance was given first title reading and public hearing on December 1, 2008.
Given second title reading on December 15, 2008.
Given third title reading on January 5, 2009.
Given fourth title reading on January 20, 2009.
Given fifth title reading on February 2, 2009.
Given sixth title reading on February 17, 2009.
Given seventh title reading.

ORDINANCE NO. O-10-2009
AN ORDINANCE AMENDING SECTION 935.07 OF THE CODIFIED ORDINANCES OF THE CITY OF TROY, OHIO RELATED TO CEMETERY FEES

This Ordinance was given first title reading.


COMMENTS OF THE MAYOR.
Mayor Beamish commented that:
-On February 27, he and Mr. Titterington participated in the visit of the Lord Mayor of Westminster, England to Troy High School to formally invite the school band to participate in the January 1, 2010, London, England parade.
-The State of the City address will be held March 23.
-The Mayor’s Prayer Breakfast will be held March 7.
-Habitat for Humanity will hold a ground breaking for three new homes on March 22.


COMMENTS OF THE DIRECTOR OF PUBLIC SERVICE AND SAFETY.
Mr. Titterington commented that:
-The Troy Miami County Public Library has offered to rent the City space for $1 per month at the former Fire Station 2 for the storage of the train the Police Auxiliary uses in parades and at events. The City is appreciative of this arrangement.
-As has been reported, Troy and Piqua had been exploring the sale of Troy water to Piqua. At a Piqua Council workshop, a financial analysis of this was discussed with an indication that Piqua representatives felt it could be more cost effective to build a new Water Plant than to pursue an arrangement with Troy. Piqua has shared the financial analysis with Troy. Troy officials would like to continue to explore the water sale option with Piqua officials.

COMMENTS OF PRESIDENT OF COUNCIL.
Mrs. Baker commented that Council has been invited to participate in the May 25 Memorial Day Parade.


COMMENTS OF MEMBERS OF COUNCIL.
-Mr. Kendall presented the Mayor with a new river corridor map from the Miami Valley Regional Planning Commission (MVRPC) that recognizes Troy for three river associated events. Mr. Kendall also stated that on February 28, at the Wright State University Adventure Series, Troy’s River Adventure Series was recognized.




There being no further business, the meeting adjourned at 7:26 p.m.
