October 18, 2010 MINUTES OF COUNCIL A regular session of Troy City Council was held Monday, October 18, 2010, at 7:00 p.m. in Council Chambers. Members Present: Clark, Kendall, Phillips and Schweser. Upon motion of Mr. Schweser, seconded by Mr. Phillips, Mr. Hutchinson was excused from this meeting by unanimous roll call vote. Upon motion of Mr. Kendall, seconded by Mr. Schweser, Mr. Harrah was excused from this meeting by unanimous roll call vote. Upon motion of Mr. Clark, seconded by Mr. Phillips, Mr. Stubbs was excused from this meeting by unanimous roll call vote. Presiding Officer: Martha A. Baker, President of Council Others Present: Michael L. Beamish, Mayor Grant D. Kerber, Director of Law Richard L. Cultice, Auditor INVOCATION: An invocation was given by Council member Schweser. MINUTES: The Director of Law gave a summary of the minutes of the October 4, 2010, meeting of Troy City Council. The report of the Finance Committee was corrected to reflect Mr. Kendall as Chairman. A motion was made by Mr. Kendall, seconded by Mr. Schweser, to approve these minutes as corrected. Motion passed by unanimous roll call vote. COMMITTEE REPORTS: Buildings, Streets & Sidewalks Committee: Mr. Kendall reported as follows: 1) Committee recommends approval of the emergency consent legislation provided by the Ohio Department of Transportation (ODOT) regarding ODOT rehabilitating the Broadford Bridge in FY 2014 at no cost to the City. 2) Committee recommends legislation be prepared authorizing the Director of Public Service and Safety to reimburse Miami County the amount of $32,730.09 for ODOT paving portions of Peters Road within the City of Troy as the paving of Peters Road from Archer Drive to the Peters Road Bridge over I-75 was a County 2010 paving project. 3) Committee recommends legislation be prepared authorizing the Director of Public Service and Safety to advertise for bids and enter into a contract for the Terry Drive Bridge Reconstruction project at a cost not to exceed $115,000. R-59-2010 PRELIMINARY RESOLUTION CONSENTING TO THE REHABILITATION OF THE BROADFORD BRIDGE WITHIN THE CITY OF TROY, OHIO BY THE OHIO DEPARTMENT OF TRANSPORTATION AND DECLARING AN EMERGENCY This Resolution was given first title reading. RESOLUTION NO. R-60-2010 RESOLUTION AUTHORIZING THE DIRECTOR OF PUBLIC SERVICE AND SAFETY OF THE CITY OF TROY, OHIO TO ENTER INTO A CONTRACT FOR THE TERRY DRIVE BRIDGE RECONSTRUCTION PROJECT This Resolution was given first title reading. Discussion. In response to questions of Mr. Schweser, it was stated that the Terry Drive Bridge was constructed in the early 1970s, it spans a culvert, the bridge is the highest such bridge to be repaired based on condition, and construction should take place over the winter. R-61-2010 RESOLUTION AUTHORIZING THE DIRECTOR OF PUBLIC SERVICE AND SAFETY TO REIMBURSE MIAMI COUNTY FOR PAVING A PORTION OF PETERS ROAD WITHIN THE CITY OF TROY, OHIO This Resolution was given first title reading. ORDINANCE NO. O-23-2010 AN ORDINANCE AMENDING CHAPTER 933 OF THE CODIFIED ORDINANCES OF THE CITY OF TROY, OHIO This Ordinance was given first title reading on October 4, 2010. Given second title reading. ORDINANCE NO. O-25-2010 ORDINANCE AMENDING ORDINANCE NO. O-30-2009, AS AMENDED BY ORDINANCE NUMBERS O-15-2010 AND O-17-2010, APPROPRIATING FUNDS NECESSARY FOR THE VARIOUS DEPARTMENTS AND OFFICES OF THE CITY OF TROY, OHIO, FOR THE YEAR 2010 AND DECLARING AN EMERGENCY This Ordinance was given first title reading. ORDINANCE NO. O-26-2010 AN ORDINANCE REPEALING SECTION 1149.09 AND AMENDING SECTION 521.07 OF THE CODIFIED ORDINANCES OF THE CITY OF TROY, OHIO This Ordinance was given first title reading. COMMENTS OF THE MAYOR: Mayor Beamish noted future events, including: - Meet the Candidate Forum is 10-21, 7:30 p.m., at Troy Junior High School. - Make a Difference Day volunteer opportunities will be held 10-23. Mayor Beamish also introduced Kaouthar Batoun, a high school student from Morocco who is an exchange student to the US for this school year. COMMENTS OF MEMBERS OF COUNCIL: - Mr. Schweser suggested a more frequent leaf collection from Ridge Ave. east to the city limits due to the quantity of leaves from so many mature trees piled in the street for so long and creating parking issues. AUDIENCE COMMENTS: - Scott Frank of DP&L provided Council with information regarding DP&L’s Government Energy Audit Rebates that pay for energy efficiency plans.
