MINUTES OF COUNCIL

A regular session of Troy City Council was held Monday, May 3, 2010, at 7:00 p.m. in Council Chambers.

Members Present: Clark, Harrah, Hutchinson, Kendall, Phillips, Schweser and Stubbs.

Presiding Officer: Martha A. Baker, President of Council

Others Present: Michael L. Beamish, Mayor
Patrick E. J. Titterington, Director of Public Service & Safety
Richard L. Cultice, City Auditor
Grant D. Kerber, Director of Law

PLEDGE OF ALLEGIANCE: Boy Scout Nathan Cantrell led the Pledge of Allegiance.
INVOCATION: An invocation was given by Council Member Harrah.
INTRODUCTION: Charles Cochran, retiring President of the Troy Area Chamber of Commerce and the Troy Development Council introduced John C. (J C) Wallace, who will assume those positions upon Mr. Cochran’s retirement.

MINUTES: The Clerk gave a summary of the minutes of the April 19, 2010, meeting of Troy City Council. There were no corrections or additions to these minutes. A motion was made by Mr. Clark, seconded by Mr. Harrah to approve these minutes. Motion passed by unanimous roll call vote.

COMMITTEE REPORTS:
Buildings, Streets & Sidewalks Committee: Mr. Harrah, Chairman, reported that Committee recommends legislation be prepared authorizing the Director of Public Service and Safety to submit an application to the Ohio Department of Development for a CDBG grant in the amount of $500,000 to be used for public infrastructure improvements to Dye Mill Road. Committee noted that this will be combined with another $510,000 grant to fund the improvements.

Recreation & Parks Committee: Mr. Stubbs, Chairman, reported that Committee recommends legislation be prepared authorizing the Director of Public Service and Safety to accept the dedication of land (0.245 acres) from the Fraternal Order of Eagles to be used for a gateway access to Treasure Island Park.

RESOLUTION NO. R-25-2010
RESOLUTION AUTHORIZING THE DIRECTOR OF PUBLIC SERVICE AND SAFETY OF THE CITY OF TROY, OHIO, TO SUBMIT AN APPLICATION TO THE OHIO DEPARTMENT OF DEVELOPMENT FOR USE OF COMMUNITY DEVELOPMENT FUNDS

This Resolution was given first title reading.

Mr. Harrah moved for suspension of rules requiring three readings. Motion seconded by Mr. Kendall.
Yes: Phillips, Clark, Schweser, Harrah, Kendall, Stubbs and Hutchinson.
No: None.
Mr. Harrah moved for adoption. Motion seconded by Mr. Clark.

ORDINANCE NO. O-7-2010
AN AMENDED ORDINANCE CHANGING THE ZONING DESIGNATION FOR VARIOUS PARCELS OF PROPERTY LOCATED IN THE CITY OF TROY, OHIO, FROM B-3, CENTRAL BUSINESS DISTRICT TO EITHER OR-1, OFFICE RESIDENTIAL DISTRICT OR TO B-1, LOCAL RETAIL DISTRICT

Mr. Schweser moved for adoption. Motion seconded by Mr. Phillips.

ORDINANCE NO. O-12-2010
ORDINANCE ACCEPTING THE REAL PROPERTY BEING DONATED BY THE FRATERNAL ORDER OF EAGLES

This Ordinance was given first title reading.

Mr. Clark moved for suspension of rules requiring three readings. Motion seconded by Mr. Hutchinson.
Yes: Harrah, Kendall, Stubbs, Hutchinson, Phillips, Clark and Schweser.
No: None.
Mr. Hutchinson moved for adoption. Motion seconded by Mr. Harrah.
Yes: Kendall, Stubbs, Hutchinson, Phillips, Clark, Schweser and Harrrah.

MAYOR’S COMMENTS:
Mayor Beamish commented as follows:
- Thanked the Eagles for the donation of land (O-12-2010). He feels that will become an enhanced entrance to Treasure Island Park.
- The 4-30 ground breaking for ConAgra was a welcome event.
ConAgra ground breaking will result in jobs for the area. The ConAgra expansion will bring 200 jobs.
- The 4-30 Arbor Day Celebration included a tree planted in memory of Douglas Chaney at the Community Park.
- On 5-3 a tree donated by Baird Funeral Home and Chaney’s Nursery was planted in Riverside Cemetery in memory of the late Cemetery Superintendent Lew Deeter.
- May 7 is the Peace Officers Memorial Recognition.
- There will be a WACO dedication on May 8.
- Troy received an honorable mention recognition as a Bicycle Friendly Community by the League of American Cyclists. Only three Ohio communities were recognized.
- On May 21, Culver’s Restaurant will partner with the City in recognizing National Ride Your Bike to Work Day. Those that cycle to Culver’s between 4-7 p.m. will receive refreshments. There will be other events at Culver’s at that time.

SERVICE & SAFETY DIRECTOR’S COMMENTS:
Mr. Titterington commented as follows:
- Two bids were received for the drop slide at the Troy Aquatic Park, with one under the authorization.
- The City of Kettering recently completed the annual water and sewer rate survey. Troy has among the lowest combined rates, is in the bottom 25% and is 14.75% less than the average combined rate.
- As the City had planned, some repairs to the Adams Street Bridge started this date and will take about three days to complete.

COUNCIL PRESIDENT COMMENTS:
Mrs. Baker commented that on May 15 there will be a dedication of a new sculpture and open house at the Hobart Welding Institute.

COUNCIL MEMBERS COMMENTS:
- Mr. Clark also commented regarding the Peace Officers Memorial Ceremony May 7 at noon.
- Mr. Phillips congratulated Planning Director Tim Davis and his wife on the birth of their second daughter.

AUDIENCE COMMENTS:
- Mike Burkholder, 465 W. Staunton Road, requested the City’s response to a questionnaire from the Dayton Business Journal, breakdown of income tax revenues between individuals and businesses, and the total number of individual tax returns filed for any year. Mr. Burkholder stated that the new Slim Jim line at ConAgra is a good event and the jobs are good, but not the tax abatement to the company. His calculation is that the jobs will bring about $115,000 in taxes to the General Fund, or $620 per job based on an average salary of $35,000. He commented that it would take 1,600 more new jobs to balance the General Fund and asked what it would take to get those jobs. Mr. Burkholder then listed a number of one-time and on-going expenses and calculated the number of jobs each would be equal to.
