MINUTES OF COUNCIL

A regular session of Troy City Council was held Monday, August 2, 2010, at 7:00 p.m. in Council Chambers.

Members Present: Clark, Harrah, Kendall, Phillips, Schweser and Stubbs.
Upon motion of Mr. Harrah, seconded by Mr. Kendall, Mr. Hutchinson was excused from this meeting by unanimous roll call vote.

INVOCATION: An invocation was given by Council Member Clark

MINUTES: The Clerk gave a summary of the minutes of the July 19, 2010, meeting of Troy City Council. There were no corrections or additions to these minutes. A motion was made by Mr. Clark, seconded by Mr. Harrah, to approve these minutes. Motion passed by unanimous roll call vote.

RESOLUTION NO. R-43-2010
RESOLUTION AUTHORIZING THE DIRECTOR OF PUBLIC SERVICE AND SAFETY OF THE CITY OF TROY, OHIO TO ENTER INTO AN AGREEMENT WITH THE F.O.P. OHIO LABOR COUNCIL, INC., FULL-TIME CLERKS AND CUSTODIAN OF THE TROY POLICE DEPARMTENT, AND DELCARING AN EMERGENCY

This Resolution was given first title reading.

Mr. Harrah moved for suspension of rules requiring three readings. Motion seconded by Mr. Phillips.

ORDINANCE NO. O-17-2010
ORDINANCE AMENDING ORDINANCE NO. O-30-2009 APPROPRIATING FUNDS NECESSARY FOR THE VARIOUS DEPARTMENTS AND OFFICES OF THE CITY OF TROY, OHIO, FOR THE YEAR 2010 AND DECLARING AN EMERGENCY

This Ordinance was given first title reading.

Discussion. Mr. Schweser stated he understood the additional appropriation for the Hobart Arena was to pay for acts booked, and asked if this will increase the General Fund transfer to the Hobart Arena Fund. Mr. Cultice and Mr. Titterington explained that the transfer will not be increased, that the reappropriation is not connected to the General Fund, that funds are or will be available within the Arena fund but cannot be expended unless the appropriation (expenditure) is increased by this action, and that the reappropriation recognizes the future revenue and expenses in the Hobart Arena Fund.

ORDINANCE NO. O-18-2010
ORDINANCE FIXING SALARES AND WAGES OF CERTAIN EMPLOYEES OF THE CITY OF TROY, OHIO AND DECLARING AN EMERGENCY

This Ordinance was given first title reading.

Mr. Harrah moved for suspension of rules requiring three readings. Motion seconded by Mr. Stubbs.

COMMENTS OF DIRECTOR OF PUBLIC SERVICE & SAFETY:
Mr. Titterington commented as follows:
-There was an article in the Sunday newspaper about the trade mission expenses and benefits that was very good, but the headline was incorrect about the amount expended, which was just under $11,000 and not the over $14,000 stated in the headline. Mr. Titterington noted that the 2010 expenses were less than in 2008, and that the administration is trying to keep these costs down while seeing the benefits of that mission and building on relationships from the trade mission.
- There was a major water main break on Sunday, August 1, in the area of York Lane and Ridge Ave. He stated that a line split and 12’ of water line had to be replaced, the line has been repaired, there were minimal shutoffs of water, but as the line serves the high service area west of Ridge Avenue, the line experienced depressurization resulting in a boil order that will be in effect until City staff and EPA permits the lifting of the boil order. He further commented that City staff is to be commended for the quick response, and also appreciated is the quick response of the media in helping to disseminate information. Mr. Titterington noted that a One Call Now call first went out to the entire City data base and a second call was sent out only to those affected by the boil order.

COMMENTS OF THE DIRECTOR OF LAW:
Mr. Kerber commented that following the comments of Mr. Barker at the prior meeting, he and Police Capt. Long met with Mr. Barker, discussed his concerns in depth, that Mr. Barker indicated he is please with the response of the Police Department but frustrated with the situation, and it was explained to Mr. Barker that the City could not be involved in evicting someone from a residence, but that other options were discussed with Mr. Barker.

COMMENTS OF MEMBERS OF COUNCIL:
- Mr. Schweser commented that the One Call Now system (used for notification for an 8-1 main break) does not reach those residences where only cell phones are used unless the citizens add their cell phone numbers to the One Call Now data base (private company now owned or operated by the City), and suggested a link from the City web site so citizens could add phone numbers to the One Call Now data base.
- Mr. Clark noted that the sport of curling is now going on in Troy as an additional recreation opportunity, and interested persons can contact the Hobart Arena regarding lessons.

AUDIENCE COMMENTS:
Lester Conard, 1210 S. Clay Street, regarding the Aug 1 water main break, stated there was a resident in the area impacted by the boil order that person did not receive a call and did not know about the water issue until the evening news. He suggested asking the TV media to show such information on the screen to help get information out quicker. Mrs. Baker commented that the media was contacted right away, and started carrying information as it was available; however, showing information on the screen is up to the TV station. Mr. Titterington also stated that the media was quickly contacted by the 911 system and there was a scrolling across the TV screen earlier in the day on one station. He stated that all avenues were used to try to get information out.
